WHAT PRESSURE COOKER BURN LAWSUITS HAVE YOU HANDLED?

Our pressure cooker attorneys have sued numerous pressure cooker companies around the US. We’ve handled hundreds of burn injury claims involving some major brands and products. Some of the pressure cooker companies our pressure cooker lawyers handled claims against include:

Tristar Power Pressure Cooker XL – Our national product liability lawyers handled numerous pressure cooker lawsuits against Tristar Products, Inc. Tristar has changed their place of incorporation and place of business over the years according to legal filings, and they have tried to avoid liability based on a class action settlement. Our office filed lawsuits in New Jersey and Florida against Tristar Products. There are different Chinese manufacturers which Tristar used, and numerous changes to the products over the past several years which may not be obvious to the consumer. We were lead counsel in the Federal consolidated action against Tristar and filed many additional lawsuits against them in Florida state court after Tristar moved their place of incorporation to Florida. We are also handling claims for customers burned by the Emeril Lagasse branded pressure cookers, which are also distributed by Tristar and look very similar to the defective Power Pressure Cookers we investigated.

Instant Pot – Our lawyers handled several claims against Instant Pot for customers burned by exploding contents. Instant Pot had a recall many years ago, and the customers lodged numerous complaints of exploding lids causing severe burns.

Gourmia – Gourmia has a Smartpot, Express Pot, and other branded pressure cookers and multi-cookers. Our pressure cooker lawyers have handled numerous claims against Gourmia for victims severely burned by exploding contents after the safety mechanism on the lids failed to keep the lid sealed while under pressure.

Maxi-Matic – Our office handled claims against Maxi-Matic for customers burned by their pressure cooker. Customers alleged that the safety features didn’t work properly and allowed the lids to open while the units were pressurized.

Crock-Pot Multi-Cooker – Our product liability class action lawyers are co-lead counsel in a Crock-Pot class action lawsuit alleging numerous defects in the multi-cooker. After our pressure cooker lawsuit was filed, Sunbeam Products issued a national recall of more than 900,000 units. However, Sunbeam may have failed in its recall efforts, as alleged in the class action. Sunbeam never offered customers a refund, compensation for loss of use during the recall period, and took months before sending out replacement lids. Even then, injury complaints were reported after the recall. Evidence suggests Sunbeam was aware of burn injuries for several years before issuing the recall, which may now open them up to punitive damages. If you were burned by a Crockpot multicooker, you could be entitled to significant compensation.

Bella Housewares – We handled claims against Bella for burn injuries caused by exploding pressure cookers. They sell products through bellahousewares.com and other channels. If you were hurt by a Bella pressure cooker, you could be entitled to money damages for your injuries. They generally have different insurance policies depending on the years of the incident. Our product liability lawyers had cases against different insurance companies representing Bella.

ELECTRIC PRESSURE COOKER REVIEWS

While electric pressure cookers may work properly at times, they may also fail and cause the customer to have significant injuries. A search online reveals numerous pressure cooker complaints. These include:

“This is very dangerous! It exploded!” Amazon.com review of Gourmia pressure cooker.

“WARNING!!!!!!! This pot EXPLODED IN MY BROTHERS KITCHEN!!! Almost injuring his 4 Year Old son!!! We are filing a complaint with the company and the BBB!!” Reina D., Amazon.com review of Gourmia pressure cooker.

“It can explode when pressurized and the top flies off spewing hot food everywhere. It is a terrible product with defects and no recourse for the buyer.” Jennifer, Amazon.com review of Power Pressure Cooker XL

“This literally blew up on me. I have used pressure coolers for years and never has this happened. Burnt my arms.” Amber B., Amazon.com review of Instant Pot.

“I was cooking a roast for thanksgiving in the one pot and it exploded on me. Hot grease, water and steam covering my right hand, arm and abdomen. Having to be rushed to the hospital and burn unit 90 minutes away for 2nd degree burns. I have had to take off work because of being unable to use my right hand and have continuously been ignored by the manufacturer.” Tami K., Amazon.com review of Instant Pot.

COMMON PRESSURE COOKER INJURIES

Having handled hundreds of pressure cooker injury claims, our pressure cooker lawyers see common injuries. These include:

First degree burns – A first degree burn from a pressure cooker explosion often looks more superficial. However, it can still be very painful.

Second degree burns – A second degree burn from a pressure cooker malfunction may appear wet or moist. You may see blisters or redness in the skin as if a layer of skin was burned off.

Third degree burns – With a third degree burn, the boiling contents may reach the fat layer under the skin. The burn could sever nerves and cause numbness. Victims may need skin grafting surgery to repair the wound.

Eye injuries – When hot liquid splashes into a victim’s eye, the victim could go blind, have vision blurriness, vision issues, and possible permanent staining in the eye.
Permanent scars – Everyone’s bodies heal a little differently. While some people have great recovery from a pressure cooker explosion, others may develop keloid scars, scars over tattoos, permanent discoloration, and scars which may last forever.

Nerve damage – When the skin is burned, it could cause a victim to have increased pain or sensitivity in the burn area.

Note that these are not medical definitions you should rely on for any medical guidance or advice. You should speak with a medical professional if you were burned by a pressure cooker for a diagnosis and treatment recommendation.

HOW DO YOU TREAT A PRESSURE COOKER BURN INJURY?

Treating a pressure cooker burn depends on where the burn is and how bad the burn is. In mild burn cases, the victim may not need medical treatment beyond an initial visit and can self-treat the wound. If the victim’s burns are blistered or burn through the first layer of skin, the victim may have permanent discoloration or scars, and may require laser treatment or special cream to treat the burn area. In more severe burn cases, a victim may require skin grafting surgery using skin from the victim’s body or from a cadaver or artificial skin to help repair the skin. The victim may also require laser treatment following the surgery to minimize discoloration or scars.

HOW DO I KNOW IF I QUALIFY FOR A PRODUCT LIABILITY LAWSUIT?

Our product defect lawyers evaluate each case to see whether we believe you might be entitled to compensation for your injury or the wrongful death of a loved one. Each case is different and some cases have certain elements we need to prove to be able to bring a claim. Generally, if you used or took a product as intended and got hurt, you may have a case. There are other factors we might look at, including how long ago you were hurt or when you discovered that the product might be defective.

RECENT PRESURE COOKER RECALLS OF CONSUMER PRODUCTS

Companies may issue a voluntary recall of their products, or they may be pressured or forced to issue a recall by the U.S. Consumer Product Safety Commission. When a recall is issued, the company may offer to exchange the product or offer compensation to consumers. Consumers may also file pressure cooker explosion reports with the CPSC and put the company and others on notice of the incident. CPSC may also independently investigate pressure cooker complaints. Some pressure cooker recalls announced by CPSC include:

Crock-Pot® 6-Quart Express Crock Multi-Cookers – Our office is co-lead counsel in the Crock-pot class action filed before the recall was announced. Sunbeam Products announced a recall of more than 900,000 pressure cookers which could have a lid defect allowing the pressure cooker lid to come off while the pressure cooker is still pressurized.

Nutrex Pressure Cooker – Rena Ware recalled the Nutrex pressure cooker and said that the recalled pressure cookers can discharge steam at lower pressures than intended, posing a burn hazard to consumers. They had at least 5 complaints of burn injuries from the alleged defect.

Breville Pressure Cooker – Breville recalled pressure cookers because the sealing gasket can be incorrectly inserted upside down on the lid which can allow the unexpected release of built-up pressure. Numerous customers were burned, including at least 5 reports of customers with second degree burns to the hands, arms or stomach.

Instant Pot – Instant Pot recalled several pressure cookers because of a risk of electric shock after receiving complaints from customers.

A recall is not necessary to have a product liability lawsuit. Many companies try to hid issues from CPSC and settle claims confidentially which prevents public disclosure of all of the settlement terms. If you are searching to see if your pressure cooker was recalled after you were hurt, consult with a pressure cooker lawyer at the Law Offices of Jason Turchin to see if your cooker was recalled or if you may still qualify for compensation for your injuries.

WHAT COMPENSATION CAN I GET IF I WAS HURT BY A PRESSURE COOKER IN NEW JERSEY?

Pressure cooker injury claims may be complex since you are potentially dealing with multiple parties in the United States and out of the country. Many pressure cookers are manufactured in China, Korea and Spain, and you may have to deal with international legal issues. A NJ product liability attorney with significant experience in pressure cooker litigation can walk you through the process and fight to get you the money you deserve.

Pain and suffering – A burn victim may experience significant pain while healing from pressure cooker burns. You may also have discoloration or scars that you have to live with. Compensation for these injuries are often referred to as pain and suffering.

Burn treatment – A pressure cooker company may have to pay you for all of your past and future burn treatments. You may incur significant expenses for burn cream, skin grafting, scar revision treatment, and other scar treatments

Wage loss – If you lost work or the ability to work because of your injuries, you may be entitled to compensation for your lost income.

Medical costs – You could be entitled to reimbursement or compensation for any medical bills you incurred related to the pressure cooker burn case. This not only includes any of your past medical expenses, but could also include future medical treatment you will need to help repair your wounds or decrease your pain.

WHO IS RESPONSIBLE IF A PRESSURE COOKER EXPLODES?

If you were hurt by a pressure cooker, you may have a claim against the store where you bought the product, like Kohl’s or Walmart, but you may also have a claim against the manufacturer or distributor of the pressure cooker. Many pressure cooker companies handle the testing, design and distribution of the pressure cooker. Under New Jersey and many other state laws, these companies may be responsible to compensate you for any injuries you sustained while using the product per their direction.

WHAT TO DO AFTER A PRESSURE COOKER INJURY

  1. Contact a doctor or other medical professional immediately if you are injured.
  2. Take photographs of any burn injuries.
Take photographs or video of any damage to property, like if a pressure cooker explodes contents all over the kitchen.
  3. Take photographs of the product, packaging and any manual. This includes the top, bottom, all around the sides, inside the cooker, the underside of the lid, the plug, and the model plate if you see it.
  4. Do not return the pressure cooker to the store or send it back to the manufacturer. They may want to test it, but that should be done under attorney supervision. They could also try to get rid of the evidence.
  5. Do not give any statements to the company or any of their representatives without speaking with your lawyer.
  6. Preserve the pressure cooker, packaging and any manual. Do not throw it or any broken parts away.
  7. Speak with a product liability lawyer who understands pressure cookers.
  8. A general practitioner and many general personal injury lawyers may not have significant product liability experience or experience handling pressure cooker injury claims.

COMMON PRESSURE COOKER DEFECTS

A pressure cooker company may be responsible to pay you if you were hurt for any manufacturing defects, design defects, or dangers which they failed to warn you about. There may be issues in the base, with the locking mechanism, blocking issues with the steam valve, failure to warn about using certain foods in the cooker, and using material which is not appropriate for the lid.
